text-align: left;\">As I proceed in this very opinionated review of our constitution I will quote each piece in\u00a0<\/p><p style=\"letter-spacing: 0.1px;\"><span style=\"color: #339966;\"><span style=\"font-weight: bolder;\">Green<\/span>\u00a0<\/span>if I think it is fully in line with the Declaration of Independence (DOI) and the good parts of the Federal Constitution.\u00a0\u00a0<\/p><p style=\"letter-spacing: 0.1px;\"><span style=\"color: #ff9900;\"><span style=\"font-weight: bolder;\">Orange<\/span>\u00a0<\/span>means I have some reservations and\u00a0<\/p><p style=\"letter-spacing: 0.1px;\"><span style=\"color: #ff0000;\"><span style=\"font-weight: bolder;\">Red<\/span>\u00a0<\/span>means I consider it counter to the ideas expressed in the DOI and by our founding fathers.<\/p><p style=\"letter-spacing: 0.1px;\">My comments are in\u00a0<span style=\"font-weight: bolder;\">Black<\/span>.<\/p><p style=\"letter-spacing: 0.1px;\">My purpose here is not to tear the constitution to shreds but to help the reader think about how critically every citizen must read and digest law and how to understand what core principles are necessary and which are not.<\/p><p style=\"letter-spacing: 0.1px;\">You probably never got this kind of attention to law from your public education system.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-1d5a59a elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"1d5a59a\" data-element_type=\"section\" data-e-type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-50 elementor-top-column elementor-element elementor-element-926d373\" data-id=\"926d373\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-4151b7c elementor-widget elementor-widget-text-editor\" data-id=\"4151b7c\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p style=\"letter-spacing: 0.1px; text-align: center;\">APPROVED JULY 3, 1890<\/p><p style=\"letter-spacing: 0.1px;\">PREAMBLE<\/p><p style=\"letter-spacing: 0.1px;\">We, the people of the\u00a0<span style=\"color: #ff0000;\">State\u00a0of Idaho<\/span>,<\/p><p style=\"letter-spacing: 0.1px;\">grateful to Almighty God for our freedom,<\/p><p style=\"letter-spacing: 0.1px;\">to secure\u00a0<span style=\"color: #ff9900;\">its<\/span>\u00a0blessings and promote<\/p><p style=\"letter-spacing: 0.1px;\">our common welfare do establish<\/p><p style=\"letter-spacing: 0.1px;\">this Constitution.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t<div class=\"elementor-column elementor-col-50 elementor-top-column elementor-element elementor-element-1fb29cd\" data-id=\"1fb29cd\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-cef1c67 elementor-widget elementor-widget-text-editor\" data-id=\"cef1c67\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p style=\"letter-spacing: 0.1px;\">The preamble is important as it gives us the overall goal of the document.\u00a0 The preamble acknowledges a creator, which is extremely important, as it delegates authority to a higher place than mankind.\u00a0 It is impossible to secure our freedoms without this key premise.\u00a0 It does not attribute our blessings to God but to &#8220;It&#8217;s&#8221; (ie: freedom\u2019s) existence.\u00a0 It acknowledges that our freedom promotes our common welfare &#8211; NOT government but it also does not attribute those blessings directly to God.\u00a0 Lastly it places &#8220;We the People&#8221; as the establishers, and therefore, the owner&#8217;s of this constitution.<\/p><p style=\"letter-spacing: 0.1px;\">However there is a slight contradiction here in that it is &#8220;We the People OF the State of Idaho&#8221; which implies that the state came before the people.\u00a0 Note that State of Idaho is capitalized &#8211; it is a proper noun &#8211; a name given it by its founders but how can one be a member of a named entity before it is created?<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-8d6c125 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"8d6c125\" data-element_type=\"section\" data-e-type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-50 elementor-top-column elementor-element elementor-element-63bc475\" data-id=\"63bc475\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-5504004 elementor-widget elementor-widget-text-editor\" data-id=\"5504004\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-size: 28px; font-weight: 500; letter-spacing: 0.1px;\"><span style=\"color: #339966;\">ARTICLE I<\/span> <span style=\"color: #ff9900;\">\u2013 DECLARATION OF RIGHTS<\/span><\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t<div class=\"elementor-column elementor-col-50 elementor-top-column elementor-element elementor-element-e579092\" data-id=\"e579092\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-0dc6400 elementor-widget elementor-widget-text-editor\" data-id=\"0dc6400\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"color: var( --e-global-color-text ); font-family: var( --e-global-typography-text-font-family ), Sans-serif; font-size: var( --e-global-typography-text-font-size ); font-weight: var( --e-global-typography-text-font-weight ); letter-spacing: var( --e-global-typography-text-letter-spacing );\">The declaration of rights comes first, implying that these rights are very important.\u00a0 However, keep in mind that the constitution doesn\u2019t declare or create our rights according to our founding fathers.\u00a0 It \u201csecures\u201d these rights and they don\u2019t all have to be specifically mentioned to be our rights.\u00a0 The DOI summarizes these rights as \u201cself evident\u201d and lists that\u00a0<\/span><em style=\"color: var( --e-global-color-text ); font-family: var( --e-global-typography-text-font-family ), Sans-serif; font-size: var( --e-global-typography-text-font-size ); font-weight: var( --e-global-typography-text-font-weight ); letter-spacing: var( --e-global-typography-text-letter-spacing );\">among them<\/em><span style=\"color: var( --e-global-color-text ); font-family: var( --e-global-typography-text-font-family ), Sans-serif; font-size: var( --e-global-typography-text-font-size ); font-weight: var( --e-global-typography-text-font-weight ); letter-spacing: var( --e-global-typography-text-letter-spacing );\">\u00a0are life, liberty and the pursuit of happiness.\u00a0 Trying to list our rights in a constitution can be good in that it makes a very clear wall to secure the rights mentioned, but at the same time, it tends to reduce the importance of any other \u201cself evident\u201d rights we may have that weren\u2019t specifically mentioned.\u00a0 The simpler this is the better but these days our \u201cself evident\u201d rights are not the same as perceived back when this document was first written.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-5f9b025 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"5f9b025\" data-element_type=\"section\" data-e-type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-50 elementor-top-column elementor-element elementor-element-9071a66\" data-id=\"9071a66\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-7105464 elementor-widget elementor-widget-text-editor\" data-id=\"7105464\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"color: #339966;\"><strong style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif; font-size: var( --e-global-typography-text-font-size ); letter-spacing: var( --e-global-typography-text-letter-spacing );\">SECTION 1.<\/strong><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif; font-size: var( --e-global-typography-text-font-size ); font-weight: var( --e-global-typography-text-font-weight ); letter-spacing: var( --e-global-typography-text-letter-spacing );\">\u00a0INALIENABLE RIGHTS OF MAN. All men are by nature free and equal, and have certain inalienable rights, among which are enjoying and defending life and liberty; acquiring, possessing and protecting property; pursuing happiness and <span style=\"color: #ff0000;\">securing safety<\/span>.<\/span><\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t<div class=\"elementor-column elementor-col-50 elementor-top-column elementor-element elementor-element-faa1dbc\" data-id=\"faa1dbc\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-e7d21ef elementor-widget elementor-widget-text-editor\" data-id=\"e7d21ef\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Why are our rights Inalienable and what does that mean?\u00a0 Inalienable means that proper law cannot violate those rights because they come from God and not from Man.\u00a0 This references nature \u2013 the nature of man \u2013 it is a plea to natural law and not directly to a creator.\u00a0 Defending it is\u00a0 emphasized here, and I like that because it is usually the first piece that is taken away from us as a republic decays.\u00a0<\/p><p><strong>Safety<\/strong> is not an inherent or inalienable right \u2013 it is a state of circumstances that cannot ever be completely controlled by man.\u00a0 This is a false premise and a dagger to freedom.\u00a0 It is standard operating procedure of demagogues to invent an impossibe utopian idea and then use that as the justification for evil later on.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-cef8fb5 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"cef8fb5\" data-element_type=\"section\" data-e-type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-50 elementor-top-column elementor-element elementor-element-19397a6\" data-id=\"19397a6\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-89b6f36 elementor-widget elementor-widget-text-editor\" data-id=\"89b6f36\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"color: #339966;\"><strong>SECTION 2.<\/strong>\u00a0POLITICAL POWER INHERENT IN THE PEOPLE. All political power is inherent in the people. Government is instituted <span style=\"color: #ff9900;\">for their<\/span> equal protection and benefit, and they have the right to alter, reform or abolish the same whenever they may deem it necessary; <span style=\"color: #ff9900;\">and no <span style=\"color: #ff0000;\">special privileges or immunities<\/span> shall ever be granted that may not be altered, revoked, or repealed by the legislature.<\/span><\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t<div class=\"elementor-column elementor-col-50 elementor-top-column elementor-element elementor-element-ae521ac\" data-id=\"ae521ac\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-c07bef9 elementor-widget elementor-widget-text-editor\" data-id=\"c07bef9\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>This clearly states the American idea that the people preside over their governments and not the other way around.\u00a0 However, there is an interesting juxtaposition of a completely different idea marked in orange.\u00a0 This implies that special privileges or immunities CAN be granted legitimately by government.\u00a0 It grants the legislature (the representatives of \u201cWe the People\u201d) the right to abolish or change those privileges.\u00a0 This feels like a back door to me.\u00a0 It is not clear to me what these legit privileges might be.\u00a0 If our rights are inherent and unalienable, how can special privileges be granted to some individuals and not to others?\u00a0 Note that Section 1 emphasized \u201cequal\u201d rights and Section 2 emphasizes equal protection.<\/p><p>I put the words &#8220;for their&#8221; in orange because I would rather it have said &#8220;by them for their&#8221; which clearly states that We the People made this government for us not someone elase.<\/p><p>Note also that this kind of commentary I am giving was not afforded to the original delegates to the federal constitutional convention.\u00a0 According to the Pennsylvania Minority Report, the delegates were only allowed to vote up or down on each part of the constitution.\u00a0 No discussion or editing was allowed at the convention.\u00a0 This was a specific problem for the delegates according to the above mentioned report.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-46694b1 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"46694b1\" data-element_type=\"section\" data-e-type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-50 elementor-top-column elementor-element elementor-element-78bf1e9\" data-id=\"78bf1e9\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-e1bc1a8 elementor-widget elementor-widget-text-editor\" data-id=\"e1bc1a8\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"color: #339966;\"><strong>SECTION 3.<\/strong>\u00a0STATE <span style=\"color: #ff9900;\">INSEPARABLE <\/span>PART OF UNION. The state of Idaho is an <span style=\"color: #ff9900;\">inseparable part of the American Union<\/span>, and the Constitution of the United States is the supreme law of the land.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t<div class=\"elementor-column elementor-col-50 elementor-top-column elementor-element elementor-element-66dd2bd\" data-id=\"66dd2bd\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-f3b95c5 elementor-widget elementor-widget-text-editor\" data-id=\"f3b95c5\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"color: #000000;\">This squarely places Idaho with the North in the civil war, denying a state\u2019s right to secede from the union.\u00a0 The southern argument would be that the federal constitution mentions the right to contract as an inalienable right.\u00a0 If that right is granted individually, it must be granted collectively.\u00a0 If a state has a right to join the federal union, it logically should have the right to leave that union, especially if the federal government or other states begin to violate the very constitution they were created under.<\/span><\/p><p><span style=\"color: #000000;\">Note also how this is again in juxtaposition with acknowledging the Federal Constitution which itself recognizes the right to contract.\u00a0 This section is thus self-contradictory.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-cbc2e26 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"cbc2e26\" data-element_type=\"section\" data-e-type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-50 elementor-top-column elementor-element elementor-element-b285783\" data-id=\"b285783\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-0e9c3c4 elementor-widget elementor-widget-text-editor\" data-id=\"0e9c3c4\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"color: #339966;\"><strong>SECTION 4.<\/strong>\u00a0GUARANTY OF RELIGIOUS LIBERTY. The exercise and enjoyment of religious faith and worship shall forever be <span style=\"color: #ff9900;\">guaranteed;<\/span> and no person shall be denied any civil or political right, <span style=\"color: #ff9900;\">privilege<\/span>, or capacity on account of his religious opinions; but the <span style=\"color: #ff0000;\">liberty<\/span> of conscience hereby secured shall not be construed to dispense with oaths or affirmations, or excuse acts of licentiousness or justify <span style=\"color: #ff9900;\">polygamous or<\/span> other pernicious practices, inconsistent with morality or the peace or<span style=\"color: #ff0000;\"> safety of the state<\/span>; nor to permit any person, organization, or association to directly or indirectly aid or abet, counsel <span style=\"color: #ff0000;\">or advise<\/span> <span style=\"color: #ff0000;\">any person<\/span> to commit the crime of bigamy or <span style=\"color: #ff9900;\">polygamy<\/span>, or any other crime. No person shall be required to attend or support any ministry or place of worship, religious sect or denomination, or pay tithes against his consent; nor shall any preference be given by law to any religious denomination or mode of worship. Bigamy and <span style=\"color: #ff9900;\">polygamy<\/span> are forever prohibited <span style=\"color: #ff0000;\">in the state<\/span>, and the legislature shall provide by law for the punishment of such crimes.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t<div class=\"elementor-column elementor-col-50 elementor-top-column elementor-element elementor-element-1a67fee\" data-id=\"1a67fee\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-3d30905 elementor-widget elementor-widget-text-editor\" data-id=\"3d30905\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>This is a sticky one.\u00a0 Section 4 is actually dictating morality while saying that there is complete freedom of worship.\u00a0 What is a civil vs political right?\u00a0 And how is it that a \u201cprivilege\u201d cannot be denied someone?\u00a0 Isn\u2019t the definition of \u201cprivilege\u201d inherently revocable?\u00a0 Is this saying that a privilege granted for secular reasons cannot be revoked for religious reasons?\u00a0 It also seems strange to refer to the \u201csafety of the state\u201d rather than the \u201csafety of the people\u201d.\u00a0 Denying a person the right to give any advice seems infringing on freedom of speech.\u00a0 How does one distinguish advice from opinion?\u00a0 The idea that the state has dominion over marriage is legit if it is enforcing biblical mandates based on the ideal union of Adam and Eve, but even God granted to Abraham (and many others) the option of polygamy and divorce even when God himself was dismayed at man\u2019s hard heart.\u00a0 This seems like a move against the neighboring Mormons in Utah to me and really doesn\u2019t belong in a constitution.\u00a0 How is polygamy a crime if all parties involved agree to it and perceive no harm to themselves or others?\u00a0 There is no reference to a higher authority or inherent right or specific harm to society stated here.\u00a0 It is again, self contradictory to me and again juxtaposes freedom of religion with specific regulations upon the same.\u00a0 I am simply missing what makes polygamy a &#8220;crime&#8221;.\u00a0 It could be that our sexual norms in society have changed so much that I have become a &#8220;liberal&#8221; on this issue.<\/p><p>The founders referenced the phrase \u201ctrue religion\u201d which the bible defines as supporting widows and orphans.\u00a0 I think that a \u201ctrue religion\u201d has to be a form of belief that <span style=\"text-decoration: underline;\">does no harm<\/span> to others or to society.\u00a0 If that is correct, then specifying how polygamy (bigamy is excluded here because it involves lying to one of the spouses) is harmful to others or society in clear terms would seem to be a requirement before banning it.\u00a0 Divorce and remarriage is a form of serial polygamy and is generally accepted in our society, though not so much when this constitution was written.<\/p><p>So to be clear, I am not pro or con polygamy, I am against any law that restricts activities that are not harming anyone.\u00a0 Polygamy may be harmless in one case and very harmful in another.<\/p><p>Note that \u201cin the state\u201d is not defined in this document and is a critical thing to have in any proper constitution.\u00a0 The state is a collective group of people defined by a physical land boundary and other requirements.\u00a0 Many state constitutions have had their land boundary descriptions removed since the civil war and I think the reason for this is that the state names have changed.\u00a0 In this case, &#8220;Idaho&#8221; is not the same thing as the &#8220;State of Idaho&#8221;.\u00a0 Watch for those capitalized words &#8211; they are all proper nouns in English grammar.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-828c8c9 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"828c8c9\" data-element_type=\"section\" data-e-type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-50 elementor-top-column elementor-element elementor-element-cb26039\" data-id=\"cb26039\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-b89f778 elementor-widget elementor-widget-text-editor\" data-id=\"b89f778\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"color: #339966;\"><strong>SECTION 5.<\/strong>\u00a0RIGHT OF HABEAS CORPUS. The privilege of the writ of habeas corpus shall not be suspended, unless in case of rebellion or invasion, the public safety requires it, and then only in such manner as shall be prescribed by law.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t<div class=\"elementor-column elementor-col-50 elementor-top-column elementor-element elementor-element-30c5ca5\" data-id=\"30c5ca5\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-5ec6a81 elementor-widget elementor-widget-text-editor\" data-id=\"5ec6a81\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Habeas Corpus, in my mind, is another way of saying \u201cdue process\u201d and \u201cinnocent till proven guilty\u201d and suspending this can only be allowed when the very life of the people (not the state) is on the line.\u00a0 We have seen how emergencies have been used to usurp, even temporarily, powers not granted under normal circumstances by the constitution so I see securing this idea as good to have.\u00a0 It is a little funny how \u201cdue process\u201d i.e. \u201cprescribed by law\u201d is enforced while at the same time suspending it.\u00a0 All this language is ok if we have a working justice system with reasonable judges and lawyers \u2013 but we don\u2019t have that anymore and that is, I believe, our chief problem to overcome.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-6f32da0 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"6f32da0\" data-element_type=\"section\" data-e-type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-50 elementor-top-column elementor-element elementor-element-a2def6a\" data-id=\"a2def6a\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-65340b6 elementor-widget elementor-widget-text-editor\" data-id=\"65340b6\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"color: #339966;\"><strong>SECTION 6.<\/strong>\u00a0RIGHT TO BAIL \u2013 CRUEL AND UNUSUAL PUNISHMENTS PROHIBITED. All persons shall be bailable by sufficient sureties, except for capital offenses, where the proof is evident or the presumption great. Excessive bail shall not be required, nor excess fines imposed, nor cruel and unusual punishments inflicted.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t<div class=\"elementor-column elementor-col-50 elementor-top-column elementor-element elementor-element-3e90661\" data-id=\"3e90661\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-541d149 elementor-widget elementor-widget-text-editor\" data-id=\"541d149\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>The only stickler here is \u201cwhat is reasonable vs excessive\u201d?\u00a0 Again we rely on a reasonable justice system to sort this out.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-3cc571b elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"3cc571b\" data-element_type=\"section\" data-e-type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-50 elementor-top-column elementor-element elementor-element-131fff6\" data-id=\"131fff6\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-2f25d41 elementor-widget elementor-widget-text-editor\" data-id=\"2f25d41\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"color: #339966;\"><strong>SECTION 7.<\/strong>\u00a0RIGHT TO TRIAL BY JURY. The right of trial by jury shall remain inviolate; but in civil actions, <span style=\"color: #ff9900;\">three-fourths of the jury may render a verdict, and the legislature may provide that in all cases of misdemeanors five-sixths of the jury may render a verdict. A trial by jury may be waived<\/span> in all criminal cases, by the consent of all parties, expressed in open court, and in civil actions by the consent of the parties, signified in such manner as may be prescribed by law. In civil actions the jury may consist of twelve <span style=\"color: #ff9900;\">or of any number less than twelve<\/span> upon which the parties may agree in open court. Provided, that in cases of misdemeanor and in civil actions within the jurisdiction of any court inferior to the district court, whether such case or action be tried in such inferior court or in district court, the jury shall consist of not more than six.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t<div class=\"elementor-column elementor-col-50 elementor-top-column elementor-element elementor-element-1d2ecb5\" data-id=\"1d2ecb5\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-792e2f9 elementor-widget elementor-widget-text-editor\" data-id=\"792e2f9\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Inviolate huh?\u00a0 Then we proceed to violate it here, waived upon consent, restricting the size of the jury in lower courts and this weird lingo on \u00be or 5\/6 of a jury can render a verdict.\u00a0 Does this mean that a unanimous verdict is not required?\u00a0 Seems so.\u00a0 I would say that a not-guilty verdict might be ok to not need unanimous approval but a guilty verdict to me seems to have to be obvious to avoid punishing the innocent.\u00a0 I would always fail on the safe side here \u2013 that being, not harming the innocent.<\/p><p>A jury is a key check on the judiciary and just about the only one we have.\u00a0 The number 12 comes from biblical precedent passed on through the Saxxons to Britan and into the Common Law. 12 in the bible is considered to represent perfection and authority.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-b9984ee elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"b9984ee\" data-element_type=\"section\" data-e-type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-50 elementor-top-column elementor-element elementor-element-efb8d29\" data-id=\"efb8d29\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-c922401 elementor-widget elementor-widget-text-editor\" data-id=\"c922401\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"color: #339966;\"><strong>SECTION 8.<\/strong>\u00a0PROSECUTIONS ONLY BY INDICTMENT <span style=\"color: #ff9900;\">OR INFORMATION<\/span>. No person shall be held to answer for any felony or criminal offense of any grade, unless on presentment or indictment of a grand jury or <span style=\"color: #ff9900;\">on information of the public prosecutor<\/span>, after a commitment by a magistrate, except in cases of impeachment, in cases cognizable by probate courts or by justices of the peace, and in cases arising in the militia when in actual service in time of war or public danger; provided, that a grand jury may be summoned upon the order of the district court in the manner provided by law, and provided further, that after a charge has been ignored by a grand jury, no person shall be held to answer, or for trial therefore, upon information of public prosecutor.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t<div class=\"elementor-column elementor-col-50 elementor-top-column elementor-element elementor-element-55470ec\" data-id=\"55470ec\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-17e1724 elementor-widget elementor-widget-text-editor\" data-id=\"17e1724\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>\u201cInformation\u201d is way different than \u201csworn testimony\u201d.\u00a0 Hear-say information is normally not allowed in court but here it allows a public prosecutor to basically vouch for another\u2019s information without himself having to swear to its truthfulness.\u00a0 Dispensing with sworn testimony before prosecuting <em>anything<\/em> to me seems suspect and allows the state to protect itself (or fleece the public) via false accusation too easily.\u00a0 Again this relies on a reasonable justice system to work.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-7969e81 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"7969e81\" data-element_type=\"section\" data-e-type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-50 elementor-top-column elementor-element elementor-element-0ea77ce\" data-id=\"0ea77ce\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-8859de6 elementor-widget elementor-widget-text-editor\" data-id=\"8859de6\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"color: #339966;\"><strong>SECTION 9.<\/strong>\u00a0FREEDOM OF SPEECH. No <span style=\"color: #ff9900;\">property qualifications shall ever be required for any person to vote or hold office except<\/span> in school elections, or elections creating indebtedness, or in irrigation district elections, as to which last-named elections the legislature may restrict the voters to land owners.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t<div class=\"elementor-column elementor-col-50 elementor-top-column elementor-element elementor-element-8a94bb5\" data-id=\"8a94bb5\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-00ec803 elementor-widget elementor-widget-text-editor\" data-id=\"00ec803\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>This idea of universal suffrage is not in the federal constitution \u2013 it used to restrict the vote counts of black people.\u00a0 Land ownership is a clear test of a skin-in-the-game voter and requiring it would seem to me to be a good check on a welfare state.\u00a0 If a person wants to vote or hold office, just buy a square foot of land from somebody and you\u2019re in.\u00a0 Land ownership clearly would exclude illegal aliens as well or at least make it more difficult for those to vote.<\/p><p>When a republic is converted into a democracy, historically, it grows into socialism until the day the welfare recipients realize they can vote themselves anything they want to, at which point, the democracy collapses.<\/p><p>Our founders specifically warned us about this on many occasions.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-76b9158 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"76b9158\" data-element_type=\"section\" data-e-type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-50 elementor-top-column elementor-element elementor-element-0cfdb11\" data-id=\"0cfdb11\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-ff4f75f elementor-widget elementor-widget-text-editor\" data-id=\"ff4f75f\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"color: #339966;\"><strong>SECTION 21.<\/strong>\u00a0RESERVED RIGHTS NOT IMPAIRED. A crime victim, as defined by statute, has the following rights:<\/span><\/p><p><span style=\"color: #339966;\">(1) To be treated with fairness, respect, dignity and privacy throughout the criminal justice process.<\/span><br \/><span style=\"color: #339966;\">(2) To timely disposition of the case.<\/span><br \/><span style=\"color: #339966;\">(3) To prior notification of trial court, appellate and parole proceedings and, upon request, to information about the sentence, incarceration and release of the defendant.<\/span><br \/><span style=\"color: #339966;\">(4) To be present at all criminal justice proceedings.<\/span><br \/><span style=\"color: #339966;\">(5) To communicate with the prosecution.<\/span><br \/><span style=\"color: #339966;\">(6) To be heard, upon request, at all criminal justice proceedings considering a plea of guilty, sentencing, incarceration or release of the defendant, unless manifest injustice would result.<\/span><br \/><span style=\"color: #339966;\">(7) To restitution, as provided by law, from the person committing the offense that caused the victim&#8217;s loss.<\/span><br \/><span style=\"color: #339966;\">(8) To refuse an interview, ex parte contact, or other request by the defendant, or any other person acting on behalf of the defendant, unless such request is authorized by law.<\/span><br \/><span style=\"color: #339966;\">(9) To read presentence reports relating to the crime.<\/span><br \/><span style=\"color: #339966;\">(10) To the same rights in juvenile proceedings, where the offense is a felony if committed by an adult, as guaranteed in this section, provided that access to the social history report shall be determined by statute.<\/span><\/p><p><span style=\"color: #339966;\">Nothing in this section shall be construed to authorize a court to dismiss a case, to set aside or void a finding of guilt or an acceptance of a plea of guilty, or to obtain appellate, habeas corpus, or other relief from any criminal judgment, for a violation of the provisions of this section; nor be construed as creating a cause of action for money damages, costs or attorney fees against the state, a county, a municipality, any agency, instrumentality or person; nor be construed as limiting any rights for victims previously conferred by statute. This section shall be self-enacting. The legislature shall have the power to enact laws to define, implement, preserve, and expand the rights guaranteed to victims in the provisions of this section.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t<div class=\"elementor-column elementor-col-50 elementor-top-column elementor-element elementor-element-88f7aec\" data-id=\"88f7aec\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-b4b5638 elementor-widget elementor-widget-text-editor\" data-id=\"b4b5638\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>I\u2019m bleary eyed after reading this one.\u00a0 I would say this is ok provided we have a reasonable justice system.\u00a0 I would have to assume that violating victims\u2019 rights gives the victim the right to sue or otherwise convict the offender \u2013 the state \u2013 in a due process court.\u00a0 Yet apparently, he would have to do such a counter-suit from prison in many cases as it appears from the final paragraph that the criminal action cannot be stopped by violation of these rights.<\/p><p>There is another provision in this document that does not allow one to recieve remedy when suing the state.\u00a0 Remedy can only be granted in federal court.\u00a0 So much for enforcing this one.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-54a8718 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"54a8718\" data-element_type=\"section\" data-e-type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-50 elementor-top-column elementor-element elementor-element-6647112\" data-id=\"6647112\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-dfd74cb elementor-widget elementor-widget-text-editor\" data-id=\"dfd74cb\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"color: #339966;\"><strong>SECTION 23.<\/strong>\u00a0THE RIGHTS TO HUNT, FISH AND TRAP. The rights to hunt, fish and trap, including by the use of traditional methods, are a valued part of the heritage of the State of Idaho and shall forever be preserved for the people and managed through the laws, rules and proclamations that preserve the future of hunting, fishing and trapping. Public hunting, fishing and trapping of wildlife shall be a preferred means of managing wildlife. The rights set forth herein do not create a right to trespass on private property, shall not affect rights to divert, appropriate and use water, or establish any minimum amount of water in any water body, shall not lead to a diminution of other private rights, and shall not prevent the suspension or revocation, pursuant to statute enacted by the Legislature, of an individual&#8217;s hunting, fishing or trapping license.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t<div class=\"elementor-column elementor-col-50 elementor-top-column elementor-element elementor-element-d35a06f\" data-id=\"d35a06f\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-c8398eb elementor-widget elementor-widget-text-editor\" data-id=\"c8398eb\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>So we have a \u201cright\u201d to hunt and fish <em>unless<\/em> the legislature chooses to revoke our \u201clicense\u201d to exercise these \u201crights\u201d.\u00a0 Further, the state can restrict this right to preserve <em>future<\/em> hunting, fishing and trapping.\u00a0 We have these rights <em>forever<\/em> except not necessarily <em>now.<\/em>\u00a0 Recall that a <em>license<\/em> is permission to do something that is normally illegal.<\/p><p>A lawyer clearly wrote this.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-6cc4c89 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"6cc4c89\" data-element_type=\"section\" data-e-type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column 1.\u00a0 I did not expect to see so many problems so quickly.\u00a0 Friends, not only are our constitutions hanging by a thread in that they are not upheld as written, but even as written, our rights are contingent and tenuous in many cases.\u00a0 When combined with judges and legislators and executives that don\u2019t really even care about the constitutions we have, it makes one very worried for
